AN ACT
RELATING TO PUBLIC HEALTH; PROVIDING FOR
ADMINISTRATION OF THE STATE SANATORIUM;
PROVIDING FOR CONTRACTING FOR INSTITUTIONAL CARE
AND FOR CONTRACTS WITH DEPARTMENT OF MENTAL
RETARDATION AND OTHER AGENCIES; AMENDING
SECTIONS 32-261 AND 36-262, ARIZONA REVISED STATUTES,
AND AMENDING TITLE 36, CHAPTER 6, ARTICLE 6,
ARIZONA REVISED STATUTES, BY ADDING SECTION 36-718.
Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 36-261, Arizona Revised Statutes, is amended to
read:
36-261. Arizona state sanatorium; administration
The state tHl:JersHlosis sanatorium shall be administered by the state
department of health. The department shall:
1. Own and control all real and personal property or any interest therein
which is devoted to the use and benefit of the tul3ereHlosis STATE
sanatorium.
2. Be the official custodian of all files and records belonging to or
pertaining to the sanatorium.
3. Promulgate rules and regulations consistent with law for the operation
and administration of the sanatorium.
4. Be the recipient of and have available all appropriations for the
operation, construction, alteration, improvement and equipping of the
tul3ereulosis STATE sanatorium.
5. CONTRACT TO THE EXTENT THAT SPACE IS AVAILABLE
WITH THE STATE DEPARTMENT OF MENTAL RETARDATION OR
OTHER FEDERAL SlATE OR COUNTY AGENCIES OR

MEDICAL CARE AND TREATMENT FOR PERSONS UNDER THE
JURISDICTION OF SUCH DEPARTMENT, AGENCIES OR
INSTITUTIONS. SUCH CONTRACTS SHALL PROVIDE FOR
PAYMENT TO THE STATE SANATORIUM OF AN AMOUNT WHICH
IS NOT LESS THAN THE DIRECT AND INDIRECT COST, TO BE
DETERMINED SEMIANNUALLY, OF THE CARE AND TREATMENT
PROVIDED BY THE SANATORIUM PLUS AN ADDITIONAL TWO PER
CENT OF SUCH TOTAL COST.
Sec. 2. Section 36-262, Arizona Revised Statutes, is amended to read:
36-262. Receipt and administration of funds for control of the state
sanatorium
The state department of health is designated the official state agency to
receive,-FOR DEPOSIT IN AN APPROPRIATE ACCOUNT OF THE
PUBLIC HEALTH FUND AND administer and expend any funds granted,
contributed or made available by the federal government, appropriated by
the state, or received from fffiY other sources for the treatment, prevention
or control of tuberculosis, or FOR the OPERATION, construction,

Arizona state tl:ll:lerel:llosis sanatoriumOR FOR THE CARE AND
TREATMENT OF PERSONS PURSUANT TO SECTION 36-261,
PARAGRAPH 5. SUCH FUNDS ARE SUBJECT TO THE PROVISIONS
OF TITLE 35, CHAPTER 1, ARTICLE 4, AND PERIODIC REVIEW BY
THE JOINT LEGISLATIVE BUDGET COMMITTEE.
Sec. 3. Title 36, chapter 6, article 6, Arizona Revised Statutes, is
amended by adding section 36-718, to read:
36-718. Contracting for institutional care
THE COMMISSIONER MAY, WITH FUNDS AVAILABLE UNDER
SECTION 36-262, CONTRACT WITH ANY INSTITUTION FOR THE
CARE IN THAT INSTITUTION OF ANY TUBERCULOUS PERSON. NO
CONTRACTS SHALL BE ENTERED INTO UNLESS THE STATE
SANATORIUM REACHES AN AVERAGE DAILY PATIENT CENSUS
OF ONE HUNDRED TWENTY-FIVE PATIENTS ON A THIRTY DAY
AVERAGE.
