Senate Bill 270 AN ACT

RELATING TO PUBLIC HEALTH AND SAFETY; PROVIDING FOR A STATEWIDE SOLID WASTE MANAGEMENT PLAN; PROVIDING PROCEDURES FOR THE ADOPTION OF SUCH PLAN AND AMENDING TITLE 36, CHAPTER 1, ARTICLE 2, ARIZONA REVISED STATUTES, BY ADDING SECTION 36-132.01.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 1, article 2, Arizona Revised Statutes, is amended by adding section 36-132.01, to read:

36-132.01. COMPREHENSIVE STATEWIDE SOLID WASTE MANAGEMENT PLAN; ADOPTION PROCEDURE

  1. THE DEPARTMENT SHALL, WITHIN TWO YEARS OF THE EFFECTIVE DATE OF THIS SECTION, IN ACCORDANCE WITH GUIDELINES DEVELOPED JOINTLY WITH THE ARIZONA HEALTH PLANNING AUTHORITY PREPARE A COMPREHENSIVE STATEWIDE SOLID WASTE MANAGEMENT PLAN FOR THE COLLECTION, STORAGE, TRANSPORTATION, PROCESSING, RECLAMATION AND DISPOSAL OF SOLID WASTES.
  2. · ALL COUNTIES, INCORPORATED CITIES AND TOWNS, AND SUCH STATE AGENCIES AS DEEMED APPROPRIATE BY THE DEPARTMENT SHALL, WITHIN ONE YEAR OF THE EFFECTIVE DATE OF THIS SECTION, PREPARE AND SUBMIT TO THE DEPARTMENT A PLAN FOR SOLID WASTE MANAGEMENT FOR SUCH COUNTY, CITY, TOWN, OR STATE AGENCY. IN DEVELOPING THE STATEWIDE PLAN PROVIDED FOR IN SUBSECTION A OF THIS SECTION, THE DEPARTMENT SHALL CONSIDER PLANS DEVELOPED PURSUANT TO THIS SUBSECTION AND MAY PROVIDE TECHNICAL ASSISTANCE IN THE DEVELOPMENT OF SUCH PLANS IF REQUESTED.
  3. PRIOR TO THE ADOPTION OF THE STATEWIDE PLAN, THE DEPARTMENT SHALL SUBMIT THE PROPOSED PLAN TO THE ARIZONA HEALTH PLANNING AUTHORITY FOR REVIEW AND COMMENT WITHIN SIXTY DAYS CON CERNING THE FEASIBILITY, PRACTICABILITY, AND OTHER SUCH ASPECTS AS DEEMED NECESSARY OR AD VISABLE BY THE AUTHORITY.80 LAWS OF ARIZONACH-48
  4. AFTER REVIEWING THE COMMENTS OF THE AUTHORITY AND MAKING MODIFICATIONS AS DEEMED APPROPRIATE, THE DEPARTMENT SHALL SUBMIT THE STATEWIDE PLAN TO THE STATE BOARD OF HEALTH FOR THEIR CONSIDERATION, MODIFICATIONS, AMEND MENTS AND ADOPTION.
  5. THE STATE BOARD OF HEALTH MAY ADOPT SUCH REASONABLE REGULATIONS TO IMPLEMENT THE PRO VISIONS OF THIS SECTION AND TO PROVIDE FOR UP DATING THE STATEWIDE PLAN AS DEEMED NECESSARY.
  6. THE DEPARTMENT, COUNTIES AND INCORPORATED CITIES AND TOWNS MAY ACCEPT AND EXPEND IN ACCORDANCE WITH THE TERMS OF THE GRANT ANY FUNDS GRANTED TO IT BY THE FEDERAL GOVERNMENT, ANY POLITICAL SUBDIVISION OF THE STATE, ANY AGENCY OR BRANCH OF THE FEDERAL OR STATE GOVERNMENT, OR ANY PRIVATE AGENCY IN ORDER TO CARRY OUT THE PURPOSES OF THIS SECTION.
