AN ACT

RELATING TO PUBLIC HEALTH AND SAFETY; REQUIRING THE BOARD OF HEALTH TO ADOPT STANDARDS FOR THE REID VAPOR PRESSURE OF GASOLINE SOLD I THIS STATE, AND AMENDING SECTION 36- l 717, ARIZONA REVISED STATUTES.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 36-1717, Arizona Revised Statutes, is amended to read :

36-1717. MOTOR VEHICLE AND COMBUSTION ENGINE EMISSION; CONTROL DEVICES; STANDARDS

  1. The board of health shall within ninety days after the effective date of this section adopt rules and regulations setting forth standards controlling the release into the atmosphere of air contaminants from motor vehicles and combustion engines. Any rules or regulations promulgated pursuant to this section shall be consistent with pro visions of federal law, if any, relating to control of emissions from motor vehicles or combustion engines. This authority shall apply to implement the provisions of sections 28-955 and 28-327.
  2. The state board of health shall within ninety days after the effective date of this section adopt rules and regulations which specify the content, methods, procedures and techniques to be utilized in a statewide vehicular air pollution testing and control program and shall determine whether this program is being conducted according to the rules and regulations adopted by the board. The division of air pollution control shall administer the regulations and seek compliance with conditions of any contractual arrangements which the state may make for inspectional services related to air pollution control.
  3. Subject to the provisions of subsection A, notwithstanding the provisions of any other section of this chapter, the board of health may, upon the recommendation of the division, approve or disapprove design of missions control devices for motor vehicles and combustion engines.
  4. At such time as t he state board of health shall determine that effective motor vehicle and combustion engine emission control devices are generally available at reasonable cost, the state board of health shall, by rules and regulation, require the installation of such emission control devices on motor vehicles and combustion engines.

E. THE BOARD OF HEALTH SHALL ESTABLISH BY REGULATION MAXIMUM STANDARDS FOR THE REID VAPOR PRESSURE OF GASOLINE AS DETERMINED IN ASTM METHOD 0323 (TEST FOR VAPOR PRESSURE FOR PETROLEUM PRODUCTS (REID METHOD) ) FOR GASOLINE SOLD IN THIS STATE FOR USE IN MOTOR VEHICLES. THE MAXIMUM STANDARDS MAY NOT BE LESS THAN THOSE SPECIFIED FOR THE STATE OF ARIZONA I ASTM D439-70 (SPECIFICATIONS FOR GASOLINE). THE BOARD, I ADOPTING SUCH REGULATIONS, SHALL GIVE FULL CONSIDERATION TO CLIMATIC CONDITIONS AND MAY PROVIDE THAT THE MAXIMUM STANDARDS IMPOSED THEREBY SHALL BE APPLICABLE ONLY DURING THOSE PERIODS OF TIMES AND ONLY IN THOSE AREAS, WHICH THE BOARD DETERMINES NECESSARY IN ORDER TO CARRY OUT THE PURPOSES OF THIS SECTION.
